The 2003 Convention Research Bibliography provides an interactive bibliography of research references related to the Convention for the Safeguarding of the Intangible Cultural Heritage and its implementation.

Based on work initiated in 2012, this project is hosted by UNESCO and led by an editorial group of independent researchers, with the support of volunteer researchers.

It intends to foster better communication among researchers working in the field of intangible cultural heritage and enhance dissemination of ICH-related research for all stakeholders involved in the implementation of the 2003 Convention (States Parties, communities, practitioners, civil society, UNESCO Secretariat and others).

      On Hunger focuses on the interface between food and public health and on the flawed regulations intended to protect us. Food not only represents nourishment for the body; it also possesses other valuable aspects that are protected by international legal instruments. Westra argues for the importance of effecting radical changes: to protect and improve the present system of food production and distribution. Starting from several reports produced by the FAO and the WHO, Westra argues for the need of a complete and radical re-evaluatio of current practices and systems in order to meet the obligation of the international community to prevent hunger. There is a particular emphasis on the problems facing the poor in the third world, but also the different but equally grave problems of those in developed countries, where the emphasis remans on corporate profit rather than on the protection of individuals, as present dangers affect all, starting from the children of all ages. Most of the existing literature on hunger and food does not address the harm that current practices inflict on people globally. Laura Westra’s On Hunger focuses on the interface between food and public health and on the flawed regulations intended to protect us. Food not only represents nourishment for the body; it also possesses other valuable aspects that are protected by international legal instruments. Westra argues for the importance of effecting radical changes: to protect and improve the present system of food production and distribution. This timely book explores every aspect of this challenge, from the impact of climate change, the role of the media and obligations to future generations. Westra also considers the legality of financial contributions on the part of agribusiness to political figures and campaigns, as well as their intrusion in the drafting of bills and regulatory regimes. Finally, the book highlights more positive developments,including the expansion of the remit of the International Criminal Court to include environmental crimes. On Hunger offers an original take on this increasingly important issue and will provide fascinating reading for scholars and students in law, philosophy and human rights.

      This concept paper reports on a review of the literature relating to the safeguarding and mobilisation by local communities of Intangible Cultural Heritage (ICH) in the context of disasters triggered by natural hazards. What is the current state of knowledge regarding the impact of natural hazards on ICH? What role is played by ICH in mitigating the impacts of these disasters on local communities? ICH is a relatively new concept in the public domain and in the disaster risk management (DRM) field, and is seldom explicitly identified in these terms. The concept of local knowledge, which is more widely used and understood, serves as a synonym or proxy for ICH in much of the literature on disasters. To date, however, the two distinct fields and literatures of ICH and disasters are only rarely in direct conversation with each other. Local knowledge and, by extension, ICH play a crucial role in mitigation at every step of the disaster management cycle, from preparedness through response to recovery. This role is increasingly evident and appreciated in disaster management and risk reduction practice. However, there is only limited understanding of the longer-term structures that generate and sustain ICH and render it viable, and of the broader significance of non-technical ICH for disaster mitigation.

      Kunqu (pronounced kwun-chü) is a form of Chinese musical theater. The first syllable of the name is derived from the name of its birthplace Kunshan, a small city in the Lower Yangzi region, situated between Shanghai and Suzhou. The second syllable, “qu,” denotes either aria lyrics, a vocal style, an aria repertory, or a type of musical theater, depending on contexts. As musical theater, kunqu rose to a dominant position on the national stage around the mid-sixteenth century when the Ming dynasty (1368–1644) was at the height of its glory. The Ming had remarkable achievements in culture and the arts, and Ming skills in printing and the manufacture of porcelain and silk reached high technical achievements. Flourishing commerce in the Ming period created a new level of prosperity and supported a sophisticated urban life in which kunquformed an important component.       The practices of intangible cultural heritage are central to the cultural heritage of humanity, which comprises practices from a plethora of different cultures as well as monuments listed as world cultural heritage. These oeuvres and practices play an important role in the cultural identity of human beings: “The ‘intangible cultural heritage’ means the practices, representation, expressions, knowledge skills — as well as the instruments objects, artefacts and cultural spaces associated therewith — that communities, groups and, in some cases, individuals recognize as part of their cultural heritage” (UNESCO, 2003a, Article 2). These practices are manifested in the following domains: a) oral traditions and expressions, including language as a vehicle of the intangible cultural heritage; (b) performing arts; (c) social practices, rituals and festive events; (d) knowledge and practices concerning nature and the universe; (e) traditional craftsmanship.

      According to the theory of cultural memory raised by the German scholar Jan Assmann, ritual and text are two main mediums of cultural memory.Among all kinds of social rituals, annual festivals are most publicly,well organized and often accompanied by narrative literature with historical backgrounds.Thus, they offer the best possibilities for reserving and communicating cultural memory.In modern society, the participation of mass media enables the wide spread of ceremonial events, so that rural festivals become common cultural heritage of the entire population.They attract more public interest than in earlier times.The revitalized traditional festivals transmit cultural messages from the past, and play a symbolic role in the public consciousness of ethnicity, nationality and cultural identity.The maintenance of traditional festivals should be undertaken under the cooperation between the central and local government, experts and media.As a form of cultural transmission and a symbol of nation, their content and performances can be modified according to aesthetic and socio-educational needs.

      In the light of the spirit of some international conventions, the paper explains the essence of the tourism education in the intangible culture heritage originative place, and discusses the object, practical meaning and the major content of the tourism education in the intangible culture heritage originative place. It considers that there are three major problems in the tourism education in China: The first is the conflict of the tendency of industrialization and political utilitarianism in education and the value inclination of the tourism education in the intangible culture; the second is the conflict of the education executive system and the administrative system; the third is the conflict of supply and demand of tourism education in the intangible culture originative place. Supported by an analysis of the statistic data from national tourism bureau, this paper points out the social responsibility that the tourism education units should shoulder.

      Cultural heritage embodied in traditional crafts is an integral part of any nation which reflects the culture and tradition of a particular region. Although the importance of handicraft has been widely recognized, the literature regarding preservation of traditional craft is scarce. The present paper aimed to explore and identify issues faced by traditional craftsmanship in developing countries and to address those issues in order to contribute to the sustainability of traditional craft heritage and ensure continuous transmission of craft skills and knowledge from generation to generation. Our study identified several key issues which poses substantial challenges to the preservation of traditional craft heritage in developing countries. In order to add empirical evidence, we examined the case of Pakistani handicraft industry that provided further understanding of highlighted issues which traditional craft heritage face. We have suggested some policies to promote, develop and preserve the traditional craft heritage. The significance of these policy suggestions is underlined with the case study of Pakistan.

      Recognised as intangible cultural heritage, the tradition of the Viennese coffeehouse culture attracts tourists. This study examines how the intangible heritage tourism of the Viennese coffeehouse culture has been developed and mutually constructed through the relational network of social practice and how it has functioned as a significant legacy for the development of Viennese cultural tourism. The results reveal that five groups of significant actors/actants have impacted the development of the intangible heritage tourism of Viennese coffeehouses: celebrities, pastries, indoor settings, recommendations, and servicescapes. These actors/actants have become collectively embedded into the relational network of Viennese coffeehouse culture.

      This essay addresses the contentious local responses to intangible cultural heritage (ICH) protection in a local context. The following ethnographic case study concerns the living tradition of worshipping the ancient sage-kings Yao and Shun in several villages in Hongtong County, Shanxi Province, China. Named as an item of national ICH in 2008, the official title of this local tradition is Hongtong Zouqin Xisu, “the custom of visiting sacred relatives in Hongtong.” I explore the ways local people have responded to the safeguarding of ICH, with a focus on shifting actors and power relations within interconnected communities.

      This paper documents a vernacular method of interpreting and safeguarding intangible heritage in an ethnic Miao village in China. Tracing the conflicting discourses of ritual in different stages of the past and the present, it shows how ritual practices were transformed by imperial Qing officials in the mid-nineteenth century, demonised and denounced as feudal superstition during the Cultural Revolution (1966–1976), exploited as cultural resources for ethnic tourism since the early twentieth century and involved in the evaluation system of intangible cultural heritage in the twenty-first century. Based on ethnographic materials collected in 2008 and 2009, this paper argues that it is the inherited vernacular narratives and ritual performances that are negotiating with the state’s constant effort of shaping the ritual through various discourses, constructing the meaning of inheritance and safeguarding the intangible heritage within the community.

    • Abstract:

      In recent years, the protection of traditional knowledge and cultural expressions has received widespread international attention. In 2003, delegates of 190 countries adopted the Convention on the Safeguarding of Intangible Cultural Heritage. Two years later, the Convention on the Protection and Promotion of the Diversity of Cultural Expressions was adopted under the auspices of UNESCO. In 2007, the General Assembly of the United Nations adopted the Declaration on the Rights of Indigenous Peoples. In addition, there are active developments to strengthen protection of traditional knowledge and cultural expressions in the areas of international trade, intellectual property, and biological diversity. Taken together, all of these conventions, declarations, laws, and policy discussions have helped establish a new international framework for the protection of intangible cultural heritage. As part of the "Law Without Borders: Current Legal Challenges Around the Globe" Symposium, this article disaggregates intangible cultural heritage into its two components: intangible heritage and cultural heritage. The article explores the similarities and differences between the protection of cultural relics and that of intellectual property. It then examines eight different objectives for establishing the new framework. It also discusses four different challenges confronting the implementation of this framework: (1) the mode of protection; (2) the power to define protectible subject matters; (3) the means to identify those materials; and (4) the justifiability of international intervention. The article concludes by revisiting a crucial similarity between the protection of cultural relics and that of intellectual property - the need for enforcement and the related challenges. It suggests that countries with significant problems in both areas are likely to provide rich and fertile grounds for future research.

      This study examines a South Korean shamanic ritual to explore how UNESCO recognition complicates preexisting discourses concerning the interface of cultural and economic values in heritage making and heritage maintenance. Although UNESCO seldom discusses the economic issues associated with heritage status, financial factors are a key concern and a source of tension among local and national stakeholders when valorizing selected local culture for translocal use and recognition. Local perceptions and use of the global project are closely related to the goals and protocols of the 2003 ICH Convention.

    • Abstract:

      The paper presents ongoing research on craft and design for sustainability in the Yangtze River Delta (YRD), China. Based on previous research into the relationship between craft and design for sustainability, and literature on value, a typology of five values pertaining to craft is defined. This research investigates values and craft practices in the YRD through identifying the direction of craftwork development in the region and evaluating them against the defined five values. It is found that some crafts in the YRD are commercialized and strongly influenced by cosmopolitanism and consumerism, while some crafts with high intrinsic values are still in decline and need specific interventions. However, these interventions need more context-based consideration and evaluation. What might be regarded as “excessive” intervention in commercial promotion and mass-production could potentially homogenize local crafts, thereby undermining their distinctiveness and their intrinsic values. The aim of this paper is to (a) identify the direction of different craftworks categories in the YRD; and (b) evaluate them with the defined five values in order to inform future design intervention

      The writer of this paper holds that with the rapid developing trend of economic globalization, inheritance and protection of intangible cultural heritage has aroused world-wide concern. Though teaching ethnic cultural knowledge on campus is consistent with inheritance and protection of intangible cultural heritage through school education, the over-all implementation of this work can only be carried out through the legislation of NPC. This paper intends to prove that legislation is an important safeguard for an effective protection of intangible cultural heritage in school education by giving some examples.

      Pour savoir si le patrimoine culturel immatériel peut servir de langage commun dans le Bassin méditerranéen, il nous faut, en premier lieu, chercher des éléments d’union, des traits communs aux peuples millénaires qui, durant des siècles, ont habité la région. Il est donc nécessaire de remonter le cours de l’histoire pour remémorer les alliances, les guerres, les influences et les contacts qui ont marqué la vie des civilisations méditerranéennes. Telle est la seule façon de donner un sens à la notion de patrimoine culturel immatériel, d’en faire un langage commun dépassant les identités et les limites territoriales nationales. Après en avoir reconnu le caractère unificateur, il faudra identifier l’authenticité et la spécificité de ce patrimoine ainsi que les raisons de sa patrimonisation.

      在《保护非物质文化遗产公约》中,联合国教科文组织将非物质文化遗产清单编制明确规定为一项基本保护措施。在清单编制模式上,无论是以政府公共部门为主导,还是以社区或非政府组织为主导,都需要有社区的参与。以社区为主导的清单编制模式有利于社区保护自身的文化实践权益,有利于清单编制的成果更有效地为社区成员共享。涵盖原住民与移民社区的清单编制模式扩大了社区参与的范围,同时为改善民生、促进族群间和谐共处、改善政府社会治理方式提供了契机。

      与《保护非物质文化遗产公约》的大多数缔约国相比,我国的非物质文化遗产名录制度在列 入名录的标准方面侧重于强调传统文化实践在历史、审美、技术和科学等方面的价值,以及对于促进中华民 族 “大认同”的意义; 而大多数缔约国的列入标准更多地体现出《保护非物质文化遗产公约》对于非遗的定 义,以及申报教科文组织两类非遗名录需满足的标准的导向,突出的是以社区为中心,尊重社区各项权利的伦理维度。从更好地履行 《公约》义务和推动国内创新社会治理的角度出发,当下我国非物质文化遗产名录 制度的改进可以参照 《公约》的宗旨和精神来讨论与修改列入名录的标准,在评审时充分吸取社区代表和民 间社团组织的意见,并在政府主导的名录制度之外探索多样化,即多种发起方的非遗普查和非遗名录制定机制。
